Welcome to The Pawfect Moment. By accessing or using our website at thepawfectmoment.com and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
The Pawfect Moment creates custom personalized pet products including calendars and coloring books. We accept pet photo submissions through our website, create personalized products using those photos, and sell the finished products through our online store.
You must be at least 18 years of age or have the consent of a parent or legal guardian to use our services. By using our services, you represent that you meet these requirements.
By submitting a photo through our forms, you represent and warrant that:

By providing your phone number on our submission forms and selecting "Yes" to the SMS consent question, you provide your prior express written consent pursuant to the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, to receive recurring automated promotional and informational SMS text messages from The Pawfect Moment, sent using an automatic telephone dialing system or prerecorded voice, at the mobile phone number you provided. You confirm that the phone number you provide is your own and that you are authorized to give consent for messages to be sent to that number.
Types of messages you may receive:
Message frequency: You may receive up to 10 messages per month. Message and data rates may apply. Consult your wireless carrier for details regarding your specific text messaging plan.
Consent is not required for purchase. You are not required to consent to receive SMS text messages as a condition of purchasing any goods or services from The Pawfect Moment. If you do not wish to receive text messages, you may still use our services — simply select "No" on the SMS consent question when submitting your form.
How to opt out: You may opt out of SMS messages at any time by replying STOP to any message you receive from us. You may also text the word STOP to our messaging number at any time. After opting out, you will receive a one-time confirmation message confirming your unsubscription. No further messages will be sent to your number.
How to re-subscribe: If you previously opted out and wish to receive messages again, you may text START to our messaging number.

No sharing of phone numbers: We will never sell, rent, loan, or share your phone number or any personal information collected through our SMS program with third parties or affiliates for their own marketing or promotional purposes.
Supported carriers: Major US carriers are supported, including but not limited to AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, Cricket, MetroPCS, U.S. Cellular, and others. Carriers are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages.
Liability: The Pawfect Moment and any mobile carriers involved in delivering messages are not responsible for incomplete, lost, late, or misdirected messages, including (but not limited to) undelivered messages resulting from any form of filtering applied by the recipient's wireless carrier or mobile device.

By submitting your information through our forms and selecting "Yes" to any consent question, you agree to transact with us electronically. You consent to receive SMS text messages, emails, and other electronic communications from The Pawfect Moment in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq. You acknowledge that your electronic consent has the same legal effect as a handwritten signature. You may withdraw your consent to receive electronic communications at any time by replying STOP to any SMS, using the unsubscribe link in any email, or by contacting us.
All orders are processed through Shopify. Prices are listed in US dollars. We reserve the right to modify prices at any time. Payment is due at the time of purchase. All sales are final unless the product is defective or does not match the order specifications.
Digital products are delivered electronically. Physical products are printed and shipped by our fulfillment partners. Delivery timelines are estimates and not guaranteed. We are not responsible for delays caused by shipping carriers or customs processing.
Because our products are custom-made with your personal photos, we generally do not offer refunds. If your product arrives damaged or significantly different from what was ordered, please contact us within 14 days of delivery at support@thepawfectmoment.com and we will work with you to resolve the issue.

To the maximum extent permitted by law, The Pawfect Moment shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount you paid for the specific product or service giving rise to the claim.
You agree to indemnify and hold harmless The Pawfect Moment from any claims, damages, or expenses arising from your use of our services, your submissions, or your violation of these Terms.
Any disputes arising out of or related to these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within thirty (30) days, either party may pursue legal remedies. Any legal action shall be brought in the state or federal courts located in the State of Delaware.
We may update these Terms from time to time. The updated Terms will be posted on this page with a new effective date. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms. Material changes to SMS terms will be communicated to active subscribers via text message.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles.
